Reform changes have relaxed the controls on some defense-related items and technology, but made understanding and complying with the regulations even more complicated. The shift of many military and space items from the ITAR to the EAR obliges exporters to learn the challenging ins and outs of the EAR. The good news is that the complex rules impose significantly fewer compliance burdens, and fewer compliance-based export delays.

Scott Gearity is President of ECTI and brings 20 years of consulting, training, and corporate export compliance program management experience. He has substantial expertise in military, dual-use, and commercial export controls. Prior to joining ECTI, Gearity managed Microsoft’s export compliance program for Europe, the Middle East and Africa from its base in Ireland and he continues to advise many non-U.S. companies affected by U.S. export controls.
Marc Binder is a Partner at International Trade Compliance Strategies. He previously was Director of Customs Compliance for Goodrich Corporation and served as Director of Customs and Export Compliance for TRW Automotive. Binder’s prior experience was Manager of Import and Export Licensing and Compliance for Lockheed Martin – Government Electronics Systems. He served two terms as a member of the U.S. Department of Commerce Regulations and Procedures Technical Advisory Committee (RPTAC) and served three terms as a member of the U.S. Department of State, Defense Trade Advisory Group (DTAG).
Timothy O’Toole, Esq. is the leader of Miller & Chevalier’s White Collar Defense Practice Group. For more than 20 years, O’Toole has laws conducted and led large-scale defense investigations involving the economic sanctions, export controls, and anti-money laundering laws. His clients include U.S. and non-U.S. financial institutions and public companies in the aviation, insurance, logistics, manufacturing, and oil and gas sectors. O’Toole provides companies and individuals with advice on compliance with U.S. economic sanctions, export controls, and anti-money laundering laws and interacts regularly with the DOJ, OFAC, DDTC and BIS in that capacity.
Donald Pearce is a Principal of Sentinel LLC. He a retired U.S. federal agent with 30 years of government service and currently serves as an experienced investigator and subject matter specialist on Strategic Trade Management and Export Control Systems. Pearce works across a wide range of stakeholders in enforcement, policy, and diplomatic affairs and shares his knowledge, insights, and experience through instruction, public speaking, and writing. He served as Regional Export Control Officer (ECO) attached to the Commercial Sector of the U.S. Embassy in Singapore and also as ECO in Moscow, Russia.
