Security (DHS) has awarded its ScanEagle(r) and Insight(tm) product certification under
the Support Anti-terrorism by Fostering Effective Technologies Act of 2002 ("SAFETY
Act"). This designation provides extra protection for developers and users of advanced
technology for homeland security applications in the event of terrorism. This protection encourages the development and deployment of anti-terrorism technologies without excessive fear of lawsuits.
In awarding SAFETY Act certification, DHS conducted a comprehensive review of the
ScanEagle/Insight Unmanned Aerial Systems (UASs) design and determined that both
platforms perform as intended, conform to Insitu's specifications, and are safe for use as intended.
"The protection that the SAFETY Act provides our UASs is a significant accomplishment
for our company," commented Brad Dezurick, Insitu Vice President and General
Counsel. "This award limits our and our customers' potential liability arising out of the use of products and services in support of homeland security. For example, our customers can now use ScanEagle with the understanding that they will have some protection from liability for claims arising out of acts of terrorism," Dezurick said.
Following the terrorist attacks on September 11, 2001, the U.S. government recognized
that liabilities stemming from potential lawsuits could diminish research, development, purchase, and use of anti-terrorism technologies. Congress passed the SAFETY Act to eliminate product and service liability against airports, airplane manufacturers, security companies, and government entities, thus protecting those security providers and users employing anti-terrorism technologies approved by DHS. It is anticipated that government procurements may soon require the use of SAFETY Act-approved products.
ScanEagle is marketed in partnership with The Boeing Company and provides intelligence surveillance and reconnaissance (ISR) services for the US Marine Corps,
US Navy, and Australian Army. The platform was introduced as an economical, longendurance UAS that could provide persistent staring and flexible deployment options. It is already a significant contributor to Operation Iraqi Freedom and the Global War on Terror for various sea- and land-based missions. The Insight platform is Insitu's commercial UAS application.
